The Policy explains the personal information we collect and process about you through, or in association with, our website located at sublocade.com, applications that we may provide, our products and services that we may offer from time to time, our related social media sites, or otherwise through your interactions with us (the website, applications, products, services, and social media pages (collectively, the “Services”).

Please note that from time to time Indivior may operate other websites, applications, or services that do not link to this Policy and may be subject to separate privacy policies, which will be provided separately or made available via those sites, applications, or services. This Policy does not govern personal information collected via websites that do not link to this Policy, and you should instead refer to the privacy policies made available in connection with those sites, applications, or services. Changes to this Policy

We reserve the right to update this Policy from time to time. In the event we make changes to this
Policy, such policy will be re-posted on our website with the date such modifications were made indicated on the top of the page. Therefore, we ask you to check this Policy occasionally to ensure that you are aware of the most recent version. We will notify you any changes where we are required to do so.

What Information Do We Collect and How Do We Use It?

For purposes of this Policy, “personal information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could be reasonably linked, directly or indirectly, with a particular individual or household. For purposes of this Policy, “personal information” should be understood to include “personal data” and similar terms under applicable privacy laws.

Indivior collects certain personal information that you provide to us voluntarily. We also collect personal information about you automatically when you access the Services, such as through the use of website “cookies”. Additionally, in some cases Indivior may obtain personal information from publicly available sources; healthcare provider directories; events management agencies; and vendor agencies, including market research and media agencies. In the preceding 12 months, we have collected the following categories of personal information:

• Identifiers (e.g., first and last name, mailing address, email address, phone number, IP address)
• Demographic information (e.g., date of birth, age, gender)
• Internet and network activity information (e.g., information about your Internet service provider; computer and device information, such as device, application, or browser type and version, browser plug-in type and version, operating system, or time zone setting; details about your use of the website and browsing history, such as access time, pages viewed, search terms entered, and URLs clicked on)
• Geolocation data (e.g., the approximate location of your computer or device)
• Inferences drawn from the information described in this section to better understand our consumers and to help improve products and services
• Other information you may provide to us (e.g., when you fill out a questionnaire, sign up for a survey, or otherwise interact with us)

We may use personal information for the following purposes: 

• To provide and administer our products and services 
• To develop, update, improve, and refine our products and services
• To provide you more relevant advertising on and off our Services, including to show you targeted advertising on our websites and on third-party websites you may visit

We may also deidentify personal information so that it cannot be used to identify you and is no longer considered personal information under applicable laws. We will maintain and use this data only in deidentified form and will not attempt to re-identify the data.

Disclosing Your Personal Information

In the preceding 12 months, we have disclosed personal information for the business purposes described above to the following categories of recipients: 

• Service providers who provide services or functions for Indivior or process information on our behalf. For example, this may include hosting our Services, storing our data, managing databases, performing analyses, or sending communications for us, among other services. These parties may receive the following categories of information: identifiers, demographic information, internet and network activity information, geolocation data, inferences, and other information you provide.
• Other Indivior Group companies. These companies may receive the following categories of information: identifiers, demographic information, internet and network activity information, geolocation data, inferences, and other information you provide.

Please note that we may also disclose personal information in the following circumstances: 

• In connection with a merger, acquisition, or other transfer of some or all of the Indivior business or its assets. In the event Indivior, or its assets, is bought or sold, personal information may be included among the transferred business assets. Personal information we obtain from or about you via the Services may be disclosed to any potential or actual third-party acquirers and may be among those assets transferred. 
• Personal information may also be disclosed to government authorities or other relevant parties in order to comply with applicable legal requirements, judicial proceedings, court orders, legal process, or lawful requests from governmental authorities. This may involve disclosing any or all of the categories of personal information we collect.

We also share your information with third parties who may use your information for their own purposes, including for purposes of their and our marketing purposes and for purposes of providing targeted advertising. These disclosures may be considered a “sale” or “sharing” of personal information under applicable privacy laws. In the past 12 months, we have “sold” or “shared” personal information to the categories of recipients listed below:

• Third-party partners, including providers of analytics and targeted advertising. These companies may receive the following categories of information: identifiers, demographic information, internet and network activity information, geolocation data, and inferences.
• Social media partners, including for analytics and targeted advertising. These companies may receive the following categories of information: identifiers, demographic information, internet and network activity information, geolocation data, and inferences.

We do not knowingly sell or share the personal information of consumers under 16 years of age, nor do we use or disclose sensitive personal information in connection with the Services. We do not sell or share data obtained through the InSupport® YourPath program with third parties.

Your Privacy Rights

You may have certain rights with respect to your personal information, which will depend on various factors including where you live and the applicable laws in your jurisdiction. Some rights may be subject to exceptions. For your own protection and that of others, we may need to verify your identity before you exercise such rights. Where applicable under local law, these rights may include:

• Right to know and access specific pieces of personal information, including to request that we disclose certain information to you about our collection, use, and disclosure of your personal information, or to request access to the specific pieces of information we have collected about you.
• Right to request deletion of personal information
• Right to request correction of personal information
• Rights to opt out of sales, sharing, and targeted advertising (as those terms are defined under applicable laws)
• Right to opt out of certain profiling activity, where profiling results in legal or similarly significant impacts on consumers
• Right not to be discriminated against for exercising your rights

Exercising Your Rights

To opt out of sales, sharing, and targeted advertising, you may do so by clicking the Do Not Sell or Share My Personal Information link at the bottom of the websites linking to this Policy and following the instructions. Where required, we also honor requests to opt-out submitted via privacy preference signals recognized under applicable local law, such as the Global Privacy Control (GPC). Only you, or an agent that you authorize to act on your behalf, may submit a verifiable consumer request related to your personal information. You may only make a verifiable consumer request for access to the specific pieces of personal information we hold about you twice within a 12-month period. The verifiable consumer request must:

• Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. For example, you should clearly state which right you wish to exercise.
• For requests from authorized agents, agents must provide proof that you gave the agent signed permission to submit the request on your behalf (or, if applicable, that you provided the agent with power of attorney).

In order to verify your identity, we may respond and request additional information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative of that person. Depending on the type of request you submit, we may ask you to provide two or more specific pieces of information about you, which may include, among other details, your name or address.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm that the personal information relates to you. When verifying a request from an authorized agent, we may also require that the consumer either verify their own identity directly with us or confirm that they provided the authorized agent permission to submit the request.

We will only use the personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request. Where applicable under local law, you may also contact us using the contact details above to appeal any decision we make relating to your request to exercise your rights.

Response Timing and Format

We will confirm receipt of a request within ten days. We endeavor to respond to verifiable consumer requests within 45 days of its receipt. If we require more time (up to 90 days total), we will inform you of the reason and extension period in writing.

We will deliver our written response by mail or electronically, at our option.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded.

Links to Third Party Platforms

Our Services or communications may contain links to third party websites, over which we exercise no control, including the form of embedded content, sponsored content or co-branded content. Except as set forth in this Policy, we do not share your personal information with those third parties and are not responsible for the privacy policies of any third party or their management of your personal information. Because they may treat your personal information differently than we do, we suggest you read the privacy policies on those third-party websites prior to submitting any personal information to such sites.

Safeguarding your Personal Information

We take reasonable precautions to protect our customers' personal information against loss, misuse, unauthorized disclosure, alteration, and destruction. Those safeguards include: (i) the pseudonymization and encryption of personal data where we deem appropriate; (ii) taking steps to ensure personal data is backed up and remains available in the event of a security incident; and (iii) periodic testing, assessment, and evaluation of the effectiveness of our safeguards. 

However, no method of safeguarding information is completely secure. While we use measures designed to protect personal data, we cannot guarantee that our safeguards will be effective or sufficient. In addition, you should be aware that Internet data transmission is not always secure, and we cannot warrant that information you transmit utilizing the Services is or will be secure.

This Policy is part of and incorporated into the Terms of Use found at http://www.indivior.com/terms-of-use/, which is a legally binding agreement between you and Indivior. This Policy applies regardless of the means used to access or provide information through the Services.

Nevada Consumer Health Data Privacy Notice

1. INTRODUCTION | HOW THIS NOTICE APPLIES TO YOU

This Nevada Consumer Health Data Privacy Notice (“Notice”) applies to Consumer Health Data that Indivior Plc and its affiliated companies (“Indivior”, “us”, “we”, “our”) collects about Nevada state residents (“Nevada Consumers”) who may be subject to Nevada law, NRS Chapter 603A (“Nevada Consumer Health Data Act”).

This Notice is intended to supplement the Indivior General Privacy Policy and other applicable privacy notices to provide additional information related to Consumer Health Data (as defined below).  Terms used herein that are defined terms under the Nevada Consumer Health Data Act shall have the meanings afforded to them therein.

“Consumer Health Data” as used in this Notice means personal information that is linked or reasonably capable of being linked to a Nevada Consumer and that Indivior uses to identify that individual’s past, present, or future physical or mental health status.

This Notice does not apply to information we may collect or receive about you that is exempt from the Nevada Consumer Health Data Act which includes, without limitation, the following:

• Personal information collected in connection with our recruitment and pre-screening of clinical trial participants and in the operation of clinical trials and related research efforts, including the provision of expanded access to drugs that are the subject of clinical trials;
• Personal information used only for public health activities and purposes;
• Personal information subject to the Fair Credit Reporting Act;
• Personal information that federal or Nevada law expressly authorizes us to collect or share, including when we function as a manufacturer under FDA regulations;
• Information that has been deidentified in accordance with HIPAA deidentification requirements;
• Publicly available information; or
• Information collected about Nevada Consumers when acting in their capacity as employees, independent contractors, or job applicants.

When we refer to “Consumer Health Data” in this Notice, it does not include any of the categories
of personal information listed above.

2.  WHAT CONSUMER HEALTH DATA DO WE COLLECT ABOUT YOU

We collect the following categories of Consumer Health Data:

• Information about health-related conditions, treatment, diseases, or diagnoses;
• Social, psychological, and behavioral interventions, such as interest in support groups;
• Medical interventions, treatments, and medication obtained or prescribed;
• Diagnoses or diagnostic testing, treatment, or medication;
• Data that identifies individuals seeking health care services;
• Any inferences of the above categories of health information derived or extrapolated from non-health information; and
• Other information that may be used to identify your health condition.

3. FOR WHAT PURPOSES DOES INDIVIOR COLLECT YOUR CONSUMER HEALTH DATA

We collect and use Consumer Health Data for the following purposes:

• To provide information about and provide our products, services and programs, including patient support programs;
• To manage our relationship with you, including customer service or to respond to your inquiries about our products and services;
• For advertising and marketing purposes, including measurement of the effectiveness of our advertisements and marketing programs; 
• To monitor and improve our websites and for internal business analytics; 
• To prevent fraud and provide security, including preventing activities that violate our Terms of Service or that are illegal, and to protect our rights and the rights and safety of our users and others; and
• To comply with the law and our legal obligations, to respond to legal process and related legal proceedings.

4. WHAT ARE THE SOURCES OF CONSUMER HEALTH DATA

We collect your Consumer Health Data from the following sources:

• Consumer Health Data that we collect from you directly, including:
  • attendance at Indivior programs and events
  • data from connected devices or profiles, with permission
  • data submitted through interactive features such as surveys or chat services
• Consumer Health Data from third party sources, including:
  • industry groups and patient associations
  • healthcare providers, insurance companies, third parties for benefit verification and program enrollment and product fulfillment services in connection with our products
  • authorized/legal representatives, family members, and caregivers
  • advertising partners and data brokers for digital marketing services and analytics
• Consumer Health Data collected from devices, including:
  • data collected through websites and apps
  • data from mobile and internet-connected devices with permission
  • data automatically collected when contacting or visiting Indivior, such as call recordings
  • data from cookies, web beacons, and similar technologies on websites or third-party websites
• Drawn from other information we collect to provide inferences about preferences, characteristics, attributes, and abilities drawn from collected data

5. CONSUMER HEALTH DATA WE MAY SHARE WITH THIRD PARTIES OR AFFILIATES

We may share Consumer Health Data:

• as otherwise permitted or required by Nevada’s Consumer Health Data Act or other applicable laws; and
• with our affiliates for the purposes described in this Notice and our General Privacy Policy. Our affiliates are listed here.

We limit the collection of Consumer Health Data by third parties over time and across different websites or online services when the Nevada Consumer uses our websites or online services. We do this by ensuring that entities whose cookies, web beacons, pixels, and other online trackers we use on our websites and online services are our vendors under applicable U.S. Privacy Laws and under Nevada’s Consumer Health Data Act. Nonetheless, please note that third parties may still be able to collect Consumer Health Data from you over time and across different websites depending on your browser, browser add-ons, and associated permissions you set on your device. This collection of Consumer Health Data by those third parties is unrelated to Indivior's collection of Consumer Health Data from you, and we encourage you to view those third parties' privacy notices for more information about their processing of Consumer Health Data and the methods they provide to allow you to opt out of such processing.

6. WHAT ARE MY CONSUMER RIGHTS UNDER NEVADA’s CONSUMER HEALTH DATA ACT AND HOW DO I EXERCISE THEM?

Nevada Consumers (as defined above) have the following rights with respect to their Consumer Health Data:

• Right to Know: The right to confirm whether we are collecting, sharing, or selling their Consumer Health Data.
• Right to Know Third Parties: The right to obtain a list of all third parties and/or affiliates with whom we have shared or sold their Consumer Health Data.
• Right to Delete: The right to request that we delete their Consumer Health Data.

Additionally, Nevada Consumers have a right to request that we stop collecting, sharing, or selling their Consumer Health Data.

To exercise these rights, please contact us via the options in Section 7 below. We may require additional information to authenticate that you made the request(s). If we are unable to authenticate the request(s) using commercially reasonable efforts and asking for additional information, we will not be able to comply with the request.

We will respond to your requests to exercise your rights in accordance with applicable law, but in any case no later than 45 days after receiving your request. In some circumstances, we may need additional time to process your request. If we expect your request is going to take us longer than normal to fulfill, we will let you know.

If your request is denied, you may appeal that decision as specified in our letter or denial. We will process and respond to your appeal within the time permitted by the Nevada Consumer Health Data Act.

“Consumer Health Data” as used in this Notice means personal information that is linked or reasonably linkable to a Washington Consumer and that identifies the Washington Consumer’s past, present, or future physical or mental health status.

This Notice does not apply to information we may collect or receive about you that is exempt from the Washington MHMD Act which includes, without limitation, the following:

• Personal information collected in connection with our recruitment and pre-screening of clinical trial participants and in the operation of clinical trials and related research efforts, including the provision of expanded access to drugs that are the subject of clinical trials;
• Personal information used only for public health activities and purposes;

• Consumer Health Data from third party sources, including:
  • industry groups and patient associations
  • healthcare providers, insurance companies, third parties for benefit verification and program enrollment and product fulfillment services in connection with our products
  • authorized/legal representatives, family members, and caregivers
  • advertising partners and data brokers for digital marketing services and analytics

  • data collected through websites and apps
  • data from mobile and internet-connected devices with permission
  • data automatically collected when contacting or visiting Indivior, such as call recordings
  • data from cookies, web beacons, and similar technologies on websites or third-party websites
• Drawn from other information we collect to provide inferences about preferences, characteristics, attributes, and abilities drawn from collected data

13. CONSUMER HEALTH DATA WE MAY SHARE WITH THIRD PARTIES OR AFFILIATES

We may share Consumer Health Data:

• as otherwise permitted or required by Washington’s MHMD Act or other applicable laws; and
• with our affiliates for the purposes described in this Notice and our General Privacy Policy. Our affiliates are listed here.

We limit the collection of Consumer Health Data by third parties over time and across different websites or online services when the Washington Consumer uses our websites or online services. We do this by ensuring that entities whose cookies, web beacons, pixels, and other online trackers we use on our websites and online services are our vendors under applicable U.S. Privacy Laws and under Washington’s MHMD Act. Nonetheless, please note that third parties may still be able to collect Consumer Health Data from you over time and across different websites depending on your browser, browser add-ons, and associated permissions you set on your device. This collection of Consumer Health Data by those third parties is unrelated to Indivior's collection of Consumer Health Data from you, and we encourage you to view those third parties' privacy notices for more information about their processing of Consumer Health Data and the methods they provide to allow you to opt out of such processing.

14. WHAT ARE MY CONSUMER RIGHTS UNDER WASHINGTON MHMD ACT AND HOW DO I EXERCISE THEM?

Washington Consumers (as defined above) have the following rights with respect to their Consumer Health Data:

• Right to Know: The right to confirm whether we are collecting, sharing, or selling their Consumer Health Data.
• Right to Know Third Parties: The right to obtain a list of all third parties and/or affiliates with whom we have shared or sold their Consumer Health Data.
• Right to Delete: The right to request that we delete their Consumer Health Data.

Additionally, to the extent consent has been obtained to collect or share Consumer Health Data, the right to withdraw consent.

To exercise these rights, please contact us via the options in Section 7 below. We may require additional information to authenticate that you made the request(s). If we are unable to authenticate the request(s) using commercially reasonable efforts and asking for additional information, we will not be able to comply with the request.

We will respond to your requests to exercise your rights in accordance with applicable law, but in any case no later than 45 days after receiving your request. In some circumstances, we may need additional time to process your request. If we expect your request is going to take us longer than normal to fulfill, we will let you know.

If your request is denied, you may appeal that decision as specified in our letter or denial. We will process and respond to your appeal within the time permitted by the Washington MHMD Act.
